Terms & Conditions

The following terms set out the agreement between you and Layla Linen, and your use of our website in any way means that you are in full acceptance of these terms, including any purchase of merchandise from Layla Linen. If you are not in agreement with any of its provisions, you must not use our website in any way. We will regularly update these terms to reflect Layla Linen’s evolving requirements, but the current version will always be available on our website. Your use of the website after terms are updated means that you agree to be bound by the revised terms.

Accessing our website and content

Every user is responsible for his/her access to the site and will be personally held accountable for compliance/non-compliance with these terms.

We work hard to ensure our website contains accurate information and content. Where ever an error or inaccuracy is found we hold the right to edit or update. We may change our content at any time and restrict access wholly or partly for reasons such as but not limited to website maintenance without any liability on our part.

Communication / Layla Linen Newsletter

By opening an account or placing an order with Layla Linen, you agree to receive communication from Layla Linen electronically either by email or phone in order to fulfil our retail relationship with you. You agree that all electronic communication will satisfy legal requirements that communication in writing would.  Personal information is collected in order to process your orders, provide you with newsletters (including electronic newsletters), respond to inquires, provide you with content, products and services and, unless you opt-out or unsubscribe, to contact you in future with information on products and services and to provide you with marketing materials via any medium including mail, telephone and SMS(Short Message Service), MMS(Multimedia Message Service). IM(Instant Messaging) and email or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future.   

When signing up for our Newsletter you consent to receive our newsletter including product updates and special offers. To use your coupon code with your first order sign up must be completed prior to placing your first order. Conditions apply minimum spend $75.

Your privacy is important to us, and we are committed to ensuring it is protected. Please read our Privacy Policy which outlines how we collect, use, protect and handle your personal information. 

Merchandise

We aspire to ensure accuracy of merchandise images, descriptions and colour displays. However, mistakes can occur, and we reserve the right to rectify them when found. Products may vary slightly in colour from merchandise images due to variable device’s ability to display colour. Buyers may therefore not classify a slightly different colour/shade as an error/fault. 

We reserve the right to correct errors/inaccuracies at any time, including after you have placed an order. On the rare occasions that our suppliers are unable to deliver high-quality products, we reserve the right to remove or edit the content on our website. 

Ordering

You must be eighteen years or older to place an order via our website. All details provided to Layla Linen when ordering must be complete and accurate; and the credit/debit card you use must be your own. We will send you an email order confirmation when you place your order and payment processed. You understand that the receipt of an order does not guarantee that merchandise is available, but only represents an offer to purchase. If merchandise is unavailable, we reserve the right to cancel the order before dispatch.

If your order is cancelled for any reason on our part your order will be fully refunded.

If merchandise is available and shipping conditions are right, you will receive an email confirming your merchandise is in transit at which time the contract between you and us shall be complete.

If we are unable to obtain authorisation for payment, suspect fraudulent activity, or where you do not meet the eligibility criteria according to this agreement, we reserve the right to refuse service. We may also refuse service to anyone at any time at our sole discretion.

Flat Rate / Free shipping

$15 Flat Rate Shipping Australia wide for orders under $200 sitewide. Free Shipping for all orders over $200 Australia Wide. 

Prices and payment

All prices are in Australian dollars and are inclusive of GST. Such prices are subject to change for reasons, including listing error and new stock price increases, and changes are effective immediately upon posting to our website.

All Payments are processed securely via AfterPay, ZipPay, PayPal Express and bank deposit or credit card (Visa and MasterCard).  To ensure payment security, we never ask for personal information and do not store any credit card numbers or details on our website. 

Delivery

$15 Flat Rate Shipping for orders under $200 and Free Shipping for all orders over $200 Australia wide. 

Time

Please note currently there are some delays in parcel delivery. Please see www.auspost.com.au for more information.

However, we will to the best of our ability Express Post orders so customers receive their orders sooner than later at no extra cost. The majority of orders will be delivered to your door within approximately 2 to 7 Business days. Delivery may exceed the expected delivery window for reasons outside our control. If your delivery is delayed or brought forward, we will let you know. 

Layla Linen includes a signature on delivery unless otherwise requested by the customer on all orders where items are valued over $50. Orders valued at $50 and under do not include a signature on delivery. However, if you do not require a signature on delivery you can send us a quick reply via email. Also, let us know if you have a preferred spot you would like your parcel left. Layla Linen does not include signature on delivery on all orders with a P.O. Box or Parcel Locker address. Tracking is included on all orders.

We do not accept liability for theft of merchandise once an order is in transit. However, if following an investigation, it is proven Australia Post or any other designated courier by Layla Linen is responsible for the loss of an order. We will replace the same for same wherever possible following the full course and conclusion of the investigation. If a customer chooses not to include signature on delivery, we cannot be responsible for the loss of an order where tracking shows the order has been delivered to the shipping address given. In either case, please contact us and we will to the best of our ability endeavour to locate your order.

Methods and Locations

Layla Linen partners with Australia Post / StarTrack to deliver orders  Australia wide. Delivery is made directly by the courier to the address provided at checkout.

We are unable to accept international delivery.

Delivery Failure

If an order return occurs as a result of an incorrect delivery address provided by you, you will be billed for additional shipping and handling fees in order to receive your goods. If an order delivered to a PO Box or Parcel Locker address is not picked up and returned to Layla Linen additional shipping and handling fees will be charged in order to receive your goods. 

An order cannot be claimed to be lost in transit if:

  • The delivery address is incorrect or unclear
  • The tracking information for the shipment shows it is still in transit
  • The item was accepted or left at the delivery address according to the instructions supplied by the customer.

Returns

We accept returns if they are made within 21 days of receipt date and as long as these conditions are met:

  • A valid reason for the return is communicated via Email/Phone 
  • Faulty Merchandise: email a summary of details with photos to sales@laylalinen.com.au including your contact preferences.
  • If you receive an order damaged in transit please take a photo immediately before and after unpackaging. Email us a summary of details with photos to sales@laylalinen.com.au including your contact preferences. We will only contact you if we need to clarify any details.
  • Returned items are unopened, new, unused, unwashed, unlaundered and in their original packaging.

Once a return is approved you will be emailed a return post label. Simply repackage then attach label securely and lodge with Australia post. Returns are treated on a case by case basis as some returns may be fully refunded once scanned at Australia Post. Otherwise, once we receive your returned order, we will organise a new order. If the order is no longer available, we will arrange a full refund.

Non-returnable items

  • Change of mind
  • Supplier images are exceptionally accurate through computer screens depending on their capability. Due to the broad colour spectrum, we cannot define a single shade of colour like white, ivory, cream, and so on due to the complex nature of colour tones and vast colour spectrum. One person’s ideal shade of white, for example, will be different from another. Due to these slight variations of colour are non-returnable.
  • Bedding and pillows
  • Clearance items
  • Returned items are not opened, used, laundered and not in their original packaging.

If an order does not qualify as returnable postage will be the responsibility of the customer. You will bear responsibility for all shipping charges, handling and restocking fees involved. Refund will only cover the cost of items returned in new condition.

Returns are not accepted in person.

Damages in Transit

If your merchandise is damaged in transit, do not accept delivery and contact us immediately via email. Attach photos or video showing the damage, and we will contact you within 48 hours. We will share your feedback with our delivery partners and suppliers to ensure both our service and the quality of the packaging is improved. If you are not at your delivery address at the time of delivery, please take photos or video showing the damage and contact us as soon as possible via email.

  • We will work together to find an outcome you are happy with. We may:
  • Offer a partial or full or refund
  • Replace the item(s) (subject to availability)
  • Arrange for the merchandise to be returned to us (we will bear the cost of return).
  • If we do not receive any such email after three days of delivery, we will not be liable for replacements or refunds.

Delivery of the wrong item

Should you receive an item other than the one you ordered, contact us as soon as possible, ideally within three business days of receipt. We will arrange a return post label to lodge at Australia Post and send you the correct item with our apologies.

Faults, Warranty Claims and Customer Rights

Layla Linen warrants all goods to be free of defects in materials and quality, and of acceptable quality and durable for the purpose for which they are designed. Warranties and guarantees provided by Australian Consumer Law.

If merchandise delivered is missing parts, faulty, or has been damaged during manufacturing, please take photos or videos clearly showing the problem. Then contact us as soon as possible, ideally within three business days of receipt.

We will work together to find a solution you are happy with, depending on the nature of the fault. We may:

  • Send you missing parts or components
  • Suggest a self-repair method (with an offer of compensation)
  • Arrange a repair by a local tradesperson in your area (with an offer of compensation)
  • Replace the product (subject to availability)
  • Offer you an alternative product
  • Offer a partial or full refund

Faults and Warranties policy does not cover the following:

  • Normal wear and tear
  • Damage arising from improper assembly, modification, abnormal use or abuse
  • Damage as a result of improper/lack of maintenance
  • Damage to external or product packaging only
  • Insignificant minor variations in dimensions, colour, grain or finis
  • Insignificant minor imperfections or superficial blemishes
  • Failure to use merchandise by the manufacturer’s instructions

Manufacturer Warranties

Occasionally some merchandise for sale may be under a separate manufacturer warranty. Communicated on the products listing. Under these circumstances, you are required to contact the manufacturer directly. However, if you are not satisfied with the outcome, contact us for help. We may liaise with the manufacturer for you, but our liability will be limited to the refund of your purchase price.

Refund Guarantee

Subject to terms and conditions applicable to ‘ Returns’.

Cancellations

If you cancel an order due to change of mind before it is dispatched. You will receive a refund in the amount you paid for the product, including shipping less small merchant fee.  Once orders have been shipped, we cannot cancel them.

Exchange

We do not offer exchanges.

Liability

To the extent permitted by law, we, our directors and employees, and affiliated third parties expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

We exclude any liability for any direct, indirect or consequential loss/damage incurred in connection with our website, products or services or with the use or inability to use our website, any linked websites and materials, including without limitation any liability for loss of income, business, profits and anticipated savings, data, and goodwill; wasted management time; and for any other loss/damage of any kind, however arising (including negligence), breach of contract or otherwise, even if foreseeable.

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation, or any other liability which cannot be excluded or limited under applicable law.

Without limitation to the foregoing, we acknowledge that laws in certain jurisdictions, including Australia, may imply warranties and conditions which cannot be excluded, restricted or modified except to a limited extent. If any such laws apply, then to the fullest extent permitted by the Competition and Consumer Act 2010, our liability is limited to the replacement or repair of goods or the supply of equivalent goods; or the payment of the cost of repairing or replacing the goods or supplying equivalent goods.

Without limitation in preceding, you agree that in no event shall our maximum aggregate liability exceed the amount paid by you for the products in question.

You agree to indemnify us, our directors, employees and representatives from and against all damages, liabilities or costs (including legal costs) arising from the use of our website, or any other products or services accessed via our website.

Third-Party Websites

We may occasionally include or offer third-party products or services on our website. These third-party sites have separate privacy policies, and we bear no liability for their content and activities. You access such sites at your own risk.

Viruses and Hacking

You must not deliberately introduce viruses, Trojans or other malicious technologically harmful material to our website, and must not attempt to gain unauthorised access to our website, its servers and connected databases.  

Whilst we do our best to make sure that our website is virus-free, we will not be liable for any loss or damage caused by a virus or other technologically harmful material that may infect your computer equipment and programs due to your use of our website.

General

Layla Linen reserves the right to revise and make necessary changes to this agreement at any time. As these changes are binding to you, it is your responsibility to check this page and take notice of any changes we make.
